Terms

This is a translation. The Polish version is legally binding.

In force from 21.10.2026 (for contracts concluded earlier, from 5.11.2026).

§ 1. General provisions

  1. These Terms set out the rules for using the services of the CrossFit Wilanów club. The services are provided by NO REP Łukasz Wysocki, based in Warsaw, Aleja Rzeczypospolitej 18/272, 02-972 Warszawa, tax ID (NIP) 5782927422 (“CFW”).
  2. The club is located at Aleja Rzeczypospolitej 12 lok. U1, 02-972 Warszawa (the “Club”).
  3. CFW runs group classes, CrossFit TEENs classes for young people and personal training sessions at the Club.
  4. A Client is a person who uses the services of CFW. A Club Member is a Client who has concluded a contract with CFW for the use of the Club’s services (the “Contract”) and holds a valid pass (the “Pass”). A Consumer is a Client who is a consumer within the meaning of the Polish Civil Code.
  5. These Terms apply to all Contracts. If a Contract provides otherwise than these Terms, the Contract prevails.
  6. The current price list is available in the eFitness app and at the Club reception (the “Price List”).
  7. Contact with CFW: email info@crossfitwilanow.pl, reception phone +48 508 096 172.
  8. The provisions of these Terms concerning a Consumer also apply to an individual who concludes a Contract directly connected with their business activity, where it follows from the content of the Contract that it is not of a professional nature for them.

§ 2. Membership and age

  1. A person who is of full age and has full legal capacity may become a Club Member.
  2. A person who is at least 13 and not yet 18 may conclude a Contract with the consent of a parent or legal guardian. The parent sends the consent by email to info@crossfitwilanow.pl. A template message is on the page crossfitwilanow.pl/treningi/teens.
  3. For a person who is at least 11 and not yet 13, the Contract is concluded by a parent or legal guardian. The parent also sends the consent referred to in section 2.
  4. Persons under 11 cannot become Club Members.
  5. Minors train in CrossFit TEENs classes or in other classes that the coach allows them to join. A parent does not have to be present during classes.
  6. CFW may confirm the parent’s consent by a reply email or by phone, at the number given in the consent.
  7. Membership is personal. A Pass may be used only by the person it was issued to. It must not be shared with other persons.
  8. Entry to the Club is by scanning the QR code in the eFitness app or by showing the Pass at reception. Club staff may ask for an identity document to confirm membership.

§ 3. Class bookings

  1. You must sign up for classes in advance in the eFitness app or on the Club’s website. The number of places is limited and bookings are served in order.
  2. A booking can be cancelled at the latest 1 hour before the class starts.
  3. If a Club Member does not come to a class and does not cancel the booking, and this happens repeatedly, CFW may temporarily block the ability to sign up.
  4. We ask you to arrive 15 minutes early for your first class. The coach may refuse entry to a person who is late.
  5. CFW may cancel a class or change the coach who leads it. CFW announces a cancellation in the eFitness app or by email.

§ 4. Passes and fees

  1. CFW offers the following Passes:
    • Drop-in: one class, valid for 7 days from purchase;
    • 4-class pass: valid for 4 weeks from purchase;
    • OPEN: a pass with no limit on entries (one class per day), renewed every 4 weeks.
  2. The prices of Passes are set out in the Price List.
  3. Drop-in and the 4-class pass are paid in advance, at purchase. The Contract expires at the end of the Pass’s validity or after all classes have been used, whichever comes first. The validity period is not extended, except in the situation described in § 10 section 2.
  4. Classes left unused on a 4-class pass can be added to the next 4-class pass, if it is bought before the previous one expires. It is enough to send a request by email to info@crossfitwilanow.pl.
  5. The OPEN pass is paid by recurring payment with a payment card linked in the eFitness app, in advance for each 4-week billing period. The first payment is taken when the Contract is concluded.
  6. Not using the Club’s services does not release you from the obligation to pay.
  7. Fees can be paid in the eFitness app, on the Club’s website or at reception, by payment card, bank transfer or Przelewy24.
  8. Fees do not include insurance. A Club Member insures themselves, for example against the consequences of accidents (NNW).

§ 5. Duration and termination of the OPEN Contract

  1. The OPEN Contract is concluded for an indefinite period. The billing period lasts 4 weeks.
  2. An OPEN Contract concluded from 21.10.2026 is binding for a minimum of 12 weeks, that is for 3 billing periods.
  3. Notice given in the first or the second billing period ends the Contract at the end of the third billing period (after 12 weeks).
  4. Notice given in the third or a later billing period ends the Contract at the end of the next billing period. The notice period is therefore from 4 to 8 weeks, depending on the day on which CFW receives the notice.
  5. Notice is given only by email to info@crossfitwilanow.pl. CFW confirms receipt of the notice by email and states the date the Contract ends in the confirmation.
  6. OPEN Contracts concluded before 21.10.2026 remain on the previous terms, except for the form of notice in section 5.
  7. Memberships and Passes cannot be suspended.

§ 6. Withdrawal from a Contract concluded online

  1. A Consumer who bought a Pass online (in the eFitness app or on the website) may withdraw from the Contract without giving a reason within 14 days of concluding it. It is enough to send a statement by email to info@crossfitwilanow.pl. The Consumer may use the model withdrawal form (Annex 2 to the Consumer Rights Act), included at the end of these Terms, but this is not mandatory.
  2. If the Consumer expressly requests that services begin before this period expires (by ticking the relevant consent when buying in eFitness, or by choosing a Pass start date that falls before the 14 days have passed) and then withdraws from the Contract, the Consumer pays for the services performed up to the moment of withdrawal, in proportion to the price of the Pass.
  3. The right of withdrawal does not apply where the service has been fully performed with the Consumer’s express consent, and the Consumer knew before performance began that they would lose the right of withdrawal once it was performed. This applies, for example, to a used Drop-in class.
  4. CFW refunds the payment within 14 days of receiving the statement, using the same payment method the Consumer used.

§ 7. Club rules and safety

  1. Sports clothing and clean indoor sports shoes to change into are required in classes. Bath footwear is required in bathrooms and showers.
  2. We recommend a medical check-up before your first class. Before a class you must tell the coach about pregnancy, illnesses (e.g. of the heart, diabetes, high blood pressure), injuries and medication that may affect training. The coach may adapt the exercises or ask for a medical certificate.
  3. The coach may refuse to admit to a class a person whose state of health does not allow it, or a person who has consumed alcohol or other intoxicants.
  4. Drinking alcohol, smoking and using intoxicating substances and doping agents are prohibited on the Club premises. Vulgar, aggressive or discriminatory behaviour towards other persons is also prohibited.
  5. Equipment is used as intended and as instructed by the coach, and is put back in its place after class. The Client is liable for damage caused through their own fault.
  6. Without CFW’s consent, no business activity may be carried out in the Club, in particular personal training, physiotherapy or dietary advice.
  7. Lockers are used only during the stay in the Club. Items left in lockers after the Club closes are moved by CFW to storage and kept until the end of the month. Valuables can be left at reception.
  8. The training floor and the reception are covered by CCTV for safety. Recordings are kept for 7 days. Details are in the Privacy Policy.
  9. The instructions of coaches and Club staff concerning safety and order must be followed.

§ 8. Liability

  1. CFW is liable for damage under general rules, including personal injury resulting from the fault of CFW, coaches or Club staff.
  2. CFW is not liable for damage resulting solely from the Client’s failure to follow these Terms or the coach’s instructions.
  3. CFW is not liable for items left in places not intended for them. For items handed in to storage at reception, CFW is liable under general rules.

§ 9. Guests of the Friends with Benefits programme

  1. A Club Member may invite a guest to the FWB Thursday class, according to the rules described on the page crossfitwilanow.pl/friends-with-benefits.
  2. Before the class, the guest accepts these Terms and informs the coach about their state of health, in line with § 7 section 2.

§ 10. Club closure

  1. CFW may temporarily close the Club or cancel classes because of renovations, cleaning work, training, decisions of the authorities or force majeure. CFW announces a planned closure in advance in the eFitness app or by email.
  2. If a closure lasts longer than 3 days in a row, CFW extends the validity of Passes by the length of the closure and, for an OPEN Pass, moves the date of the next payment by the same time.

§ 11. Complaints

  1. A complaint can be submitted by email to info@crossfitwilanow.pl or in writing at the Club reception.
  2. CFW replies to a complaint within 14 days of receiving it, by email or in writing.

§ 12. Personal data and image

  1. The rules on processing personal data are described in the Privacy Policy on the page crossfitwilanow.pl/polityka-prywatnosci.
  2. CFW publishes photos and recordings from classes in which a Client can be seen only with the Client’s separate consent, and for a minor with the parent’s consent.

§ 13. Final provisions

  1. CFW may amend these Terms for important reasons, in particular on a change in the law, the offer or the Club’s rules. CFW informs Club Members of an amendment by email at least 14 days before it takes effect. A Club Member who does not accept the changes may terminate the Contract before they take effect, without observing the minimum period or the notice period.
  2. Matters not regulated here are governed by Polish law, in particular the Civil Code and the Consumer Rights Act.
  3. Disputes are heard by the court competent under general rules. A Consumer may also use out-of-court dispute resolution, e.g. the help of a municipal consumer ombudsman.
  4. These Terms are in force from 21.10.2026 for Contracts concluded from that day. For Contracts concluded earlier they are in force from 5.11.2026.
  5. From the day these Terms take effect, the Club’s previous terms cease to apply.
